In September 2017, Anna could not consent to sex while she was handcuffed, arrested and taken into an unmarked van by two NYPD detectives, Richard Hall and Edward Martins.
The case is clear-cut, the rape kit found semen matching Martins’ and Hall’s DNA inside the then-18-year-old.
The two cops claimed the sex with the detained teenager was consensual, revealing a disturbing loophole in New York state law. The law did not assert the obvious fact that someone in police custody cannot consent to sex. While the law has been changed and the two cops fired following Anna’s case, the district attorney dropped all the rape charges, and charges for other sex crimes against the two.
So the cops, Hall and Martins, will only face charges for misconduct and bribery following the rape of Anna. Prosecutors chose continued police impunity over justice.
